Information on the regulations governing direct payments in health has been published. The document gives clear advice to help sites in the DH personal health budgets pilot programme meet the regulatory requirements. Nine sites have now been awarded powers to offer direct payments.

Public Consultation on Right to Control Regulations
On 25 February 2010 the Office for Disability Issues (ODI) launched a consultation on the regulations which govern the eight Trailblazer areas in England where the Right to Control is being tested. The Right to Control will give disabled people more choice and control over the support they need to live their lives, by enabling disabled adults to shape the support they receive, or to take money with which to buy their own services or equipment.

A new report from the NHS Confederation examines the views of 40 senior leaders from local health and social care organisations on the opportunities and challenges surrounding the roll out of personal health budgets. NHS Constitution: a consultation on new patient rights
The Government is currently consulting on new entitlements for patients, and the inclusion of these in the NHS Constitution. One of the longer-term proposals it includes is that all patients who could benefit from a personal health budget should have the right to be offered one.

Health Act 2009
Primary care trusts are already able to offer personal health budgets that do not involve giving money directly to individuals. The Health Act - which received Royal Assent on 12 November 2009 - will extend these options by allowing selected primary care trust sites to test direct payments as part of a pilot. The aim is to give patients more choice and control over the care they receive.
